Services – are real estate services provided by, including, but not limited to, the use of Comfort Realty website.
3. General provisions
3.1. The purpose of the Comfort Realty website functioning is to provide services to Users.
3.2. Comfort Realty website services are public and open. Publicity and openness means the ability to provide services to any Internet User under these terms and conditions.
4. Rights and responsibilities
4.1. Comfort Realty must:
4.1.1. Process personal data in strict compliance with the legislation of Ukraine on protection of personal data;
4.1.1. Ensure notification of Users in case of amendments to these Terms.
4.2. Comfort Realty has the right to:
4.2.1. Delete collected information in accordance with these Terms;
4.2.2. Deny access to the Comfort Realty website to the User in case of violation of these Terms and Conditions, the current legislation of Ukraine;
4.2.3. Suspend access to the Comfort Realty website completely or partially for servicing, upgrading, restoring security and implementing new services subject to notification.
4.3. The User must:

4.3.2. Comply with these Terms and Conditions;
4.3.3. Provide only accurate, truthful and reliable data;
4.3.4. Provide only the data defined by Comfort Realty;
4.3.5. Keep his/her data up to date, complete and accurate;

4.4. The User has the right to:
4.4.1. Receive services within time limits specified by Comfort Realty and on terms specified by Comfort Realty;
4.4.2. Amend the provided data;
4.4.3. Delete his/her information, including personal data, in accordance with these Terms and Conditions.
5. Policy on the protection of personal data and confidential information
5.1. Personal information received and processed by Comfort Realty
Within the scope of these Terms and Conditions, "Personal data" means personal information that the User provides about himself/herself independently to execute his/her request and (or) receive feedback, and (or) in the process of using the Comfort Realty website, including surname, name, patronymic, contact information (e-mail, phone number); standard data that is automatically obtained by http / https-server when accessing the Website and subsequent actions of the User (including IP address); information traffic between the User and Comfort Realty; for the purposes of making payments and processing data on payments made by Users, Comfort Realty may collect information about payment details of the User, including, but not limited to, details of the fact of the payment made through third-party payment systems, as well as certain details of the payer.
5.2. Methods of collecting personal data
5.2.1. Users provide personal data on their own to fulfill their request and (or) receive feedback.
5.2.2. Comfort Realty may ask the User to provide his/her personal data, indicating whether the provision of personal data is required by law or an agreement, or whether such a requirement is necessary for the conclusion of the contract and/or facilitating the conclusion of the contract, as well as whether the Users must provide personal data and possible consequences of failure to provide personal data.
5.2.3. Comfort Realty uses cookies or similar technologies that collect certain information about using the Comfort Realty Website when the User accesses, browses, or uses it. A cookie is a data file that is hosted on a computer or mobile device when it is used to visit websites. Comfort Realty does not allow third parties to place cookies on the User's device. During the time when the User does not access the Comfort Realty Website, the User's data remains anonymous and Comfort Realty can not establish connection between the User and any information provided.
5.3. Objectives of collection and processing of Personal Information
5.3.1. The purpose of these Terms and Conditions is to ensure proper protection of information about Users, including their personal data, from unauthorized access and disclosure.
5.3.2. Comfort Realty processes Personal Information for ordering services by Comfort Realty by the User.
5.3.3. The User’s consent to have his Personal Information processed is deemed to be granted at the moment when the client voluntarily submits his/her personal data on the Comfort Realty website in accordance with the stated purpose of their processing.
5.3.4. Comfort Realty warrants that Personal Information it collects is necessary and sufficient to meet the collection and processing objectives set forth in these Terms and Conditions.
5.3.5. Comfort Realty collects and processes Personal Information for the following purposes:
5.3.5.1. Allowing Users to use the Website;
5.3.5.2. Communication with the User, including sending messages, requests and information related to the use of the Comfort Realty website, as well as processing of User requests;
5.3.5.3. Improving the quality of Comfort Realty website, convenience of its use, development of new services;
5.3.5.4. Holding advertising campaigns;
5.3.5.5. Targeting advertising;
5.3.5.6. Information distribution (commercial electronic messages), including by e-mail, as well as sending sms-messages, making calls to the phone number specified in the questionnaire.
Such mailshots can be done using both the technical infrastructure of the servers and third parties.
In case of unwillingness to receive mailshots, the User has the right to contact Comfort Realty by writing an application for refusal to receive promotional materials by sending it to its e-mail info@comfort-realty.com.ua.
5.3.5.7. Conducting statistical and other studies based on impersonal data.
5.4. The User agrees that Comfort Realty during processing of personal data has the right to perform the following actions with personal data: collection, systematization, accumulation, storage, use, transfer to third parties, including outside Ukraine, destruction and other necessary actions for purposes of fulfillment of the terms and conditions and the use of the Website.
5.5 The User agrees to notify Comfort Realty immediately of any security breach related to access to the Comfort Realty Website.
5.6. The user has the right to request personal data from Comfort Realty collected by it by way of writing an application for receiving such data and sending it to the e-mail info@comfort-realty.com.ua.
Processing and response deadline to such request makes up to 30 (thirty) calendar days from the day it was received by Comfort Realty.
5.7. Comfort Realty does not disclose to third parties and does not distribute Personal Information without consent of its users (except in cases stipulated by the legislation of Ukraine). In addition, even with the consent of the user, Comfort Realty does not post personal information on publicly available resources on the Internet, since such placement does not correspond to the purposes of Personal Information collecting and processing.
5.8. In no event will Comfort Realty be liable for the consequences of the independent provision of the User's Personal Information for public access to the unlimited number of persons, including by placing this information on publicly available resources on the Internet.
In any case, the User has the right to request information from Comfort Realty on the terms of granting access to his/her personal data, in particular, information about third parties, whom his/her personal data is transferred.
5.9. Comfort Realty applies reasonable and sufficient measures to protect the User's Personal Information from accidental loss or destruction, from unlawful processing, including unlawful destruction or access to personal data.
Moreover, the User understands and agrees that information on the Internet cannot be granted absolute protection from threats existing there. In doing so, the User gives his unconditional and irrevocable consent to Comfort Realty to determine the adequate level of protection of personal data, methods and place (territory) of their storage.
5.10 The User accepts and agrees that Comfort Realty under no circumstances shall be liable for loss and/or dissemination of personal data if such loss and/or dissemination resulted from acts, due to fault or negligence of third parties.
5.11. Comfort Realty will provide the User with all reasonable help and assistance in protecting his/her rights and legitimate interests in litigation with such third parties.
5.12. Processing of the User's personal data takes place from the moment the User provides personal information and until the termination of relationship between Comfort Realty and the User.
5.13. The User may at any time change (update, supplement) his/her Personal Information or a part thereof.
5.14. The User may also request Comfort Realty to remove his/her Personal Information. In doing so, the User understands and agrees that such removal may result in the inability to use the Comfort Realty services.
5.15. Measures applied to protection of Personal Information
Comfort Realty takes the necessary technical, organizational and legal measures to protect the User's personal data from unlawful or accidental access to them, destruction, distortion, blocking, copying, distribution, and other unlawful actions.

At the same time, in order to ensure the possibility of regular use of Services, Comfort Realty can use services of third parties. The User realizes and understands that all Personal Information is provided by him/her at his/her own risk and under his/her personal responsibility, and in case of any unlawful actions by third party regarding Personal Information, the User agrees to submit claims and actions directly against such persons.
6. Responsibility
6.1. Comfort Realty does not guarantee the completeness, correctness and accessibility of the Comfort Realty website, in the event that performance is obstructed by any external factors that Comfort Realty cannot influence.
6.2. Comfort Realty is not responsible for any unauthorized access to personal data, if this was not due to Comfort Realty’s fault.
6.3. Comfort Realty is not responsible for the completeness and reliability of information provided by the Users.
6.4. The User is personally responsible for the actions he/she takes when using the Comfort Realty website.
6.5. The User is responsible for all information provided by him/her, including for its authenticity, truthfulness, and completeness.
7. Choice of law, jurisdiction and place of proceedings
The use of Comfort Realty website and these terms and conditions, the use of the website is governed by the laws of Ukraine. Unless otherwise provided by law, the courts of Ukraine have exclusive jurisdiction and are the sole bodies to resolve any dispute arising out of the use of the Comfort Realty website or these Terms and Conditions, the use of the website or in connection with the above.
These Terms and Conditions are in compliance with Ukrainian legislation and international legal acts.
8. Miscellaneous
If one of the provisions of these Terms and Conditions is void or invalidated by a court, this will not affect the validity of other terms.
